Statement regarding Wapekeka Court Incident
We extend our deepest condolences to the community of Wapekeka following the recent tragic shooting during a fly-in court sitting that resulted in the death of a community member. Our thoughts are with the family, loved ones, and all those who were present and affected by this devastating event. We hope the community finds strength and comfort in the days ahead.
In remote Northern Ontario communities, fly-in courts bring judges, lawyers, and court staff by plane to hold hearings locally, often in community buildings such as schools, community centres, Band offices and churches. These courts operate periodically—sometimes only every few months—due to logistical challenges. They are vital in providing access to justice for mostly Indigenous populations, helping reduce travel burdens and allowing for more culturally informed legal proceedings. These courts also often operate with minimal security and face infrastructure challenges.
This incident raises serious concerns for the Criminal Lawyers’ Association (CLA), including the safety protocols in place at the locations used for fly-in court proceedings, the adequacy of infrastructure supporting justice participants and community members, and the use of force by the officer involved. While all the facts are not yet known, the circumstances warrant careful scrutiny, and we support a thorough and transparent investigation.
We also urge that an inquiry be conducted into this incident and proceed without delay. It is essential that the voices of community members who rely on fly-in court services are meaningfully centered throughout the process. We hope this thoughtful examination leads to appropriate measures that enhance the safety of community members and justice participants, while preserving the community-based nature of fly-in courts.
